News Brief — Proclamation Suspending Entry of Aliens

On June 22, 2020, Donald Trump released another Proclamation that imposes restriction on foreign workers. This Proclamation extends the Presidential Proclamation 10014 issued on April 22, 2020. However, unlike the Proclamation 10014 , this one may affect ,more immigrants and nonimmigrants, as well as many U.S. employers. Here are the things you need to know about this proclamation:
1. How Long Will This Proclamation Last?
The proclamation will be valid from June 24, 2020 through December 31, 2020, with the possibility of extension. During the validity of this proclamation, the USCIS and DOL may recommend modifications. In another word, the Proclamation may be extended or shortened, though extension is more likely.
2. Who Will Be Affected By The Proclamation
a. H-1B and H-2B visa holders and their H-4 dependents;
b. J-1 visa holders and their J-2 dependents;
c. L-1 visa holders and their L-2 dependents.
3. Who Will NOT Be Affected By The Proclamation
a. Individuals who remain in the U.S.;
b. Individuals with a valid nonimmigrant visa as of the effective date of this Proclamation;
c. Other temporary visa holders (F-1, O-1, TN, E-3) and their dependents;
d. Individuals with other official travel documents include transportation letters, boarding foils, or advance paroles;
e. Lawful Permanent Residents;
f. Spouses and children of U.S. citizens;
g. Food supply chain workers seek to work in the U.S;
h. Individuals whose entry would be in the national interests of the U.S.
4. Other Exemptions Of The Proclamation
Some family-based immigrant visas are available only for children under 21 years of age. However, if a child ages out of eligibility for a visa due to this Proclamation, he or she would be exempted.
This Proclamation will not limit the ability of an individual to seek asylum, refugee status, withholding of removal, or protection, consistent with the laws of the United States.
